CRSP ยื่นข้อเสนอ "อองซาน ซู จี" แก้ไขปัญหาคุกคามชาวโรฮิงญา

เครือข่ายสิทธิผู้ลี้ภัยและคนไร้รัฐ (Coalition for the Rights of Refugees and Stateless Persons--CRSP) ซึ่งแอมเนสตี้ อินเตอร์เนชั่นแนล ประเทศไทย เป็นหนึ่งในสมาชิกเครือข่าย ส่งจดหมายเปิดผนึกถึงนางออง ซาน ซูจี ที่ปรึกษาแห่งรัฐและรัฐมนตรีต่างประเทศของเมียนมา เกี่ยวกับปัญหาการคุกคามชาวโรฮิงญาในเมียนมา เนื่องในโอกาสที่นางออกง ซาน ซูจีเดินทางเยือนประเทศไทย โดยเรียกร้องให้รัฐบาลเมียนมา (พม่า) ยุติสภาวะไร้รัฐของชาวโรฮิงญา ยุติการเลืกปฏิบัติ ตลอดจนเปิดโอกาสให้ชาวโรฮิงญาเข้าถึงความช่วยเหลือด้านมนุษยธรรมและกระบวนการยุติธรรม จดหมายดังกล่าวมีเนื้อหาดังต่อไปนี้

เรื่อง ข้อเสนอการแก้ไขปัญหาผู้อพยพย้ายถิ่นชาวโรฮิงยาจากประเทศพม่า

กราบเรียน ฯพณฯ ออง ซาน ซูจี ประธานที่ปรึกษาแห่งรัฐ และรัฐมนตรีต่างประเทศ

เนื่องในโอกาสที่ท่านมาเยือนประเทศไทย ในวันที่ 23-25 มิถุนายน 2559 เราเครือข่ายสิทธิผู้ลี้ภัยและคนไร้รัฐ (CRSP) ที่ประกอบด้วยสถาบันวิชาการ องค์กรสิทธิมนุษยชน องค์กรพัฒนาเอกชนและองค์กรศาสนาในประเทศไทยเห็นว่า ที่ได้ทำงานช่วยเหลือ ศึกษากลุ่มผู้อพยพเคลื่อนย้ายในประเทศไทย โดยเฉพาะกลุ่มผู้อพยพชาวโรฮิงยาทั้งจากประเทศพม่าและบังคลาเทศ จึงขอเรียกร้องต่อท่านดังนี้

ให้ทบทวน พรบ ความเป็นพลเมือง (สัญชาติ) ค.ศ. 1982 เพื่อยุติการไร้รัฐ ไร้สัญชาติของกลุ่มชาติพันธ์ชาวโรฮิงยา รวมถึงให้คืนสถานะสัญชาติให้กับชาวโรฮิงยาที่เคยมีสัญชาติพม่ามาก่อนการบังคับใช้ พรบ ความเป็นพลเมืองฉบับดังกล่าว

ให้รัฐบาลพม่าอนุญาตให้หน่วยงานระหว่างประเทศเข้าถึงและดำเนินกิจกรรมให้ความช่วยเหลือด้านมนุษยธรรมในพื้นที่ของกลุ่มชาติพันธ์ู โดยเฉพาะชาวโรฮิงยาในรัฐยะใข่ ที่ไม่เข้าถึงการบริการและความช่วยเหลือ

ให้ยุติการเลือกปฏิบัติต่อชนกลุ่มน้อยในรัฐต่างในประเทศพม่า โดยเฉพาะชาวโรฮิงยา ในรัฐยะใข่ และให้พิจารณารับรองสนธิสัญญาที่รับรองสิทธิมนุษชน เช่น CERD และปฏิญญาที่เกี่ยวข้องกับสิทธิของบุคคลไร้รัฐและปฏิญญาในการลดจำนวนคนไร้รัฐในประเทศ

ให้จัดตั้งคณะทำงานร่วมกับประเทศที่เกี่ยวข้อง และองค์กรระหว่างประเทศ รวมทั้งกระบวนการบาหลี (Bali Process) ในการแก้ไขปัญหาผู้อพยพลี้ภัยและผู้เป็นเหยื่อการค้ามนุษย์จากประเทศพม่าที่รวมถึงชาวโรฮิงยา และให้หลักประกันในการเข้าถึงกระบวนการยุติธรรม

ให้รัฐบาลพม่าตั้งคณะทำงานร่วมกับประเทศที่เกี่ยวข้องเตรียมความพร้อมและพิสูจน์สัญชาติในกระบวนการส่งกลับโดยสมัครใจของผู้อพยพตามแนวชายแดนไทย-พม่าโดยการมีส่วนร่วมจากประชาสังคม

Subject: Recommendations for solving the issue of Myanmar’s Rohingya refugees

Attention: The State Counsellor and Foreign Minister of Myanmar, Her Excellency Daw Aung San Suu Kyi

On the occasion of your visit to Thailand during 23-25 June 2016, we, the Coalition for the Rights of Refugees and Stateless Persons (CRSP), composed of academic institutions and civil society organizations in Thailand, dedicated to providing support to refugees and stateless people, and researching the issue of migration into Thailand, particularly the Rohingya from Myanmar and Bangladesh would like to make the following recommendations to Her Excellency as the State Counsellor and Foreign Minister of Myanmar;

Revise the 1982 Myanmar Citizenship Law to address statelessness of the Rohingya ethnic population and to reinstate nationality to Rohingya who used to be bestowed with the Myanmar nationality prior to the enforcement of the Law.

Allow international organizations access to provide humanitarian assistance in the control areas for the Rohingya in Rakhine State who have been deprived of human rights and access to basic services

Stop discriminating against the ethnic minorities in Myanmar and consider acceding to international human rights treaties including the 1969 International Convention on the Elimination of All Forms of Racial Discrimination, the 1954 Convention relating to the Status of Stateless Persons and the 1961 Convention on the Reduction of Statelessness and other related treaties to the recognition of the rights of the stateless persons and to reduce the number of stateless persons in the country.

Collaborate with concerned countries and international organizations to form a taskforce and to implement the Bali Process to address issues concerning refugees and the victims of trafficking in persons from Myanmar, including Rohingya, and to ensure their access to justice.

Collaborate with concerned countries and civil society organizations to form a working group to prepare for nationality verification to deal with the imminent return of refugees and migrants from Thailand.
